Do Work Release Programs Help to Reduce Recidivism?

presenting a study of whether work release programs are effective in preventing subsequent
incarceration for new crimes. Work release programs have been in use for nearly a century, but
they are seen as being too difficult to administer and some claim they take jobs from the areas
surrounding the prisons using work release. As the primary difficulty that a newly-released
former inmate faces is that of finding a job, however, the benefits of real job experience and the
existence of an inmate savings account are attractive. Difficulty in finding employment is cited as
a primary contributor to recidivism, and it would seem that work release programs should reduce
that pressure. Only a few states track recidivism rates at all, and most studies report mixed results
as does this one. The study concludes that even though work release does not eliminate
recidivism and the cost of maintaining an inmate is comparable to that of maintaining him in
prison, the program is beneficial if only for other experiences gained through it. Bibliography lists

The concept of “house arrest” is an old one and in the past was accomplished by placing armed guards outside the residence of the detainee. Early forms of electronic monitoring focused on ensuring that the detainee remain in a specific location. Today’s capabilities allow the offender to work, and also alert police when s/he is not where s/he is supposed to be. Not only do today’s GPS-based systems alert police to such information, they also provide the offender’s exact location. There are questions of “fairness” of such tight control, but offenders’ alternative is prison, where they are expensive guests of the state and the state’s taxpayers. This is a 7 page paper discussing fetal alcohol syndrome, its incidence, cost to society and relation in the criminal justice system. Fetal Alcohol Syndrome (FAS), Fetal Alcohol Effects (FAE), Alcohol-Related Neurodevelopmental Disorders (ARND), Alcohol-Related Birth Defects (ARBD) and alcohol-exposed Static Encephalopathy (SE) are all terms for the defect which occurs to a child when his or her mother drinks alcohol during pregnancy. It is estimated that 1 in every 10 children born have some form of this disorder which can result in mild learning disabilities to major mental, physical and developmental disorders. Children with an alcohol related disorder may or may not have physical defects and because of this most go undetected at birth. Youths with FAS exhibit impulsive and anti-social behavior, lower IQs, attention deficit, emotional instability, impairment in judgment and little awareness or consequences of their behavior among many other factors; all of which can lead them into criminal behavior. As a result, over 55% of youths and adults with FAS have spent time in a criminal facility; a fact which many critics within the legal system state may go against some of the fundamental principles of the legal system in which people must understand the rules in society and understand that the rules must be obeyed. From another legal aspect, legal critics also argue that pregnant women who drink could be considered as committing child abuse; an argument which has led some states to impose involuntary treatment and confinement of drinking women during the course of a pregnancy in order to protect the unborn child.

Foreign Criminal Rights in the United States

This is an 8 page paper discussing the argument of the rights of foreign criminals within the United States. International law provides for all prisoners to be treated with the same human rights worldwide and these rights must be maintained by all countries. In this sense, foreign criminals are to be allowed the same rights as American citizens who are criminals. Deportation of foreign criminals often leads to either the criminal not fulfilling the sentence for the crime or being deported into a country where human rights are violated and the criminal would face a more harsh sentence than consistent with the crime within the United States. If deportation is not a viable option for the fulfillment of the sentence then increased restrictions and security to prevent criminals and illegal immigrants from entering the country is now considered to be a priority. In either case, criminals who are foreigners and criminals who are citizens should be afforded the same rights under international law.
