United Kingdom: Employment Law – Unfair Dismissal

This 22 page paper reports and explains unfair dismissal as outline in the Employment Rights Act 1996 and the Employment Rights Act 2002 and the changes made in the interim. There are any number of contexts for an unfair dismissal claim, for example, claims related to maternity leave or to trade union activities. Some of the multitude of Codes of Practice are discussed, such as those ACAS issued in 2000 regarding Disciplinary and Grievance Procedures. Many of the changes in the 2002 Act were actually enacted prior to this Act, such as the qualifying years of service for unfair dismissal claims and the increase in the maximum awards. Tribunal cases are used to illustrate why a tribunal may find the dismissal fair or unfair. Data regarding the number of cases going to tribunals are reported as a justification for changes in the procedures. The writer comments on whether the 2002 Act was more advantageous to the employer or the employee as compared to the 1996 Act and its subsequent revisions. Data are included. Violence in the Workplace: Incidence, Prevention and Response

This is an 8 page paper discussing violence in the workplace. Throughout the United States, it has been estimated that each week, there is on average 20 homicides which occur within the workplace and over 18,000 instances of nonfatal violence within the workplace. Obviously, with these high numbers, workplace violence and its prevention and response is very important in regards to management strategies. Some occupations are more at risk when it comes to workplace violence especially those which have a high contact with the public or deal with the exchange of money among other risk areas. Workplace violence prevention includes environmental strategies such as increasing the distance between potential offenders and the employees with the use of bullet-proof barriers among other things; improved or increased staffing during high risk tasks; administrative strategies which include clear anti-violence policies and employee assistance programs for employees who seek help; and behavioral strategies such as training sessions in which employees learn to cope with stressful situations. If workplace violence has occurred, employers must immediately initiate a response plan which includes a response team whose members are comprised with management representatives, securities officers, employee relation specialists, employee assistance program counselors and officials from the public affairs office among others. With rigid social structure the overwhelming force behind housing populations, Britain's central and local states found themselves with a significant problem on their hands. Working class housing at the turn-of-the-century Britain reflected a conspicuous absence of civilized surroundings, with structures so decrepit and unappealing that those who were relegated to such living quarters were thought of as social fringe. In order to address this ever-mounting problem, Britain's central and local states took aim and applied the notion of modernism as a means by which to appease the working class. In addition to the basic elements of an employee contract, employees should be aware of their employers’ support of their employees and to what extent this support covers. Employee entitlements for instance may be expected but can vary from organization to organization. While employees are aware of certain rights which exist within the workplace, they should also know whether or not these rights are indeed better or worse than the rights of those who preceded them. Many organizations support education and training for their employees but in almost all cases, the education should be job related for the employers make a considerable financial investment in their employees and wish to retain them. Employees should also be aware of any community-related support their organization has and to what extent that support also benefits the organization. Lastly, employees should be aware of whether or not their organization and state supports “whistleblowers” and in what instances whistle blowing would be considered a positive step. This 5 page report discusses the 1954 blacklisted movie that tells the story of a strike among Hispanic mine workers at the Empire Zinc Corporation in New Mexico. A Mexican American family finds itself in the middle of the bitterness caused by the strike. As a political statement, it demonstrated the inter-connection that exists between working class, feminist, environmental and Latino concerns, and yet it was denounced for its “communist overtones” and banned from the public until the late 1960s. The movies writers, producer, and director had all been blacklisted and the star, the Mexican actress Rosaura Revueltas, was deported. No additional sources.
